Terms of Service

Welcome to audio-concepts.com (the “Site”), operated by AudioConcepts (“AudioConcepts,” “we,” “us,” or “our”). By accessing or using the Site, or by purchasing products from us online or in our Dallas showroom, you agree to these Terms of Service (“Terms”). Please read them carefully. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract to purchase from us. By placing an order, you represent that you meet these requirements.
2. Products and Availability
AudioConcepts is an authorized dealer for the brands featured on the Site. We carry a curated selection of high-end audio and home theater equipment. Some products are available for purchase online; many others are sold by appointment in our Dallas showroom or by special order through our staff.
Product availability, pricing, and specifications are subject to change without notice. We reserve the right to limit quantities, refuse or cancel any order, and correct errors in pricing, descriptions, or images at any time, including after an order has been submitted. If we cancel an order, we will notify you and refund any amount charged.
3. Pricing, Taxes, and Payment
All prices on the Site are listed in U.S. dollars and are exclusive of applicable taxes, shipping, delivery, and installation charges. Texas sales tax will be added to all taxable orders shipped within or picked up in Texas at the rate in effect at the time of the order.
Payment is due at the time of order unless we have agreed in writing to other terms. We accept the payment methods listed at checkout. For special orders, custom installations, or high-value purchases, we may require a deposit; deposit terms will be communicated in writing.
4. Special Orders, Trade-Ins, and Installations
Many of the products we sell are made to order, hand-built, or imported on long lead times. Lead times for special orders are estimates only and are not guaranteed. Trade-in valuations are made in writing and are valid for the period stated in the trade-in offer. Installation services are scheduled separately and are subject to a separate scope of work.
5. Listening Appointments and Showroom Visits
Listening sessions in our four dedicated rooms, the Dolby Atmos theater, and the headphone bar are available by appointment and on a walk-in basis subject to availability. We ask that you treat the equipment, vinyl, and the showroom with care. AudioConcepts reserves the right to refuse service or end an appointment at our discretion.
6. Shipping and Returns
Our Shipping Policy and Return Policy are part of these Terms and are incorporated by reference. Please review them carefully before placing an order.
7. Warranties
Products sold by AudioConcepts are covered by the manufacturer’s warranty, if any. Warranty terms vary by manufacturer; please refer to the documentation included with your product or contact us for details. EXCEPT AS REQUIRED BY APPLICABLE LAW OR EXPRESSLY STATED IN WRITING BY AUDIOCONCEPTS, ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, AUDIOCONCEPTS AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PRODUCT PURCHASED FROM US. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE OR A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT PRODUCT.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
9. Indemnification
You agree to indemnify and hold harmless AudioConcepts and its owners, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.
10. Intellectual Property
All content on the Site, including text, images, logos, photography, video, and the AudioConcepts name and marks, is owned by AudioConcepts or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from the Site’s content without our prior written permission.
Brand names and logos belonging to manufacturers we represent are the property of their respective owners and are used with permission or under fair use.
11. User Conduct
You agree not to use the Site to: (a) violate any law; (b) infringe on anyone’s rights; (c) transmit viruses or malicious code; (d) interfere with the Site’s operation; or (e) attempt to gain unauthorized access to any part of the Site, our systems, or other users’ accounts.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms, the Site, or any product purchased from AudioConcepts will be brought exclusively in the state or federal courts located in Dallas County, Texas, and you consent to the personal jurisdiction of those courts.
13. Changes to These Terms
We may update these Terms at any time. The “Effective Date” at the top reflects the most recent revision. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
